Notice: Some states necessitate certain boards such as the Board Of Medicine, Radiation Board, Cosmetology and/or Electrology Boards for recommendations or requirements to operate a laser for hair removal and/or Laser's / IPL's in general

Inquire what your state, local and medical requirements are before submitting your application for training.

In the state of FLORIDA the Florida Department of Health allows a NP or PA to work under the MD's license and insurance, but requires the medical laser operator to be under "direct", personal and responsible supervision of an Florida licensed physician.  

In the state of FLORIDA the Florida Department of Health and the State of Florida have authorized the Florida State Electrology Association (FSEA) to manage the licensing of non-medical individuals such as Electrologists'.  

A non-medical professional cannot fire the laser for hair removal in the state of Florida, except for a licensed electrologist. A non-medical professional would have to become a licensed Electrologist in Florida, take the laser training at a state approved school and then report to the FSEA. For more information on the rules click here. This then would allow the non-medical professional to work under the direct supervision of a MD.

The facility or clinic must have a documented medical director who must be a licensed medical doctor (MD). An electrology professional may own the clinic however they must adhere to the proper state protocols. Electrologists: click on both of the links to support your due deligence.

The question of Clinical Competency arises with State Licensing of individuals to perform medical or aesthetic procedures on patients. The State of Florida has authorized the State Electrology Association to manage the licensing of non-medical individuals to perform Laser Hair Removal. The law is written so that a professional must first acquire a "National Laser Certification" prior to meeting the other background and clinical experience requirements for licensing. This requirement for the National Laser Certification was written into law at a time when no such certifications existed.

 

Use of Lasers by Non-Physicians - in FLORIDA (only)

During the past few years, the Florida medical board has received an increase in calls inquiring about who may perform what type of cosmetic procedure and where. There is a particular interest in those elective cosmetic procedures that are becoming very popular with our appearance-oriented population, especially baby-boomers concerned with the signs of aging.

Physicians call to find out who they may hire so that they may expand their practice to capture this market, and non-physicians call to find out if they might be allowed to profit by performing various treatments. The Board believed that it might be helpful to share some of these questions and our responses with our readers.

Who may use lasers or intense pulse light devices to remove hair, spider veins and tattoos?

Physicians may use lasers or intense pulse light devices IPL's). In addition, physician assistants (PA), nurse practicioneers (NP) and registered nurses (RN) (not licensed vocational nurses) may perform these treatments under a physician's (MD) direct supervision.

Unlicensed medical professionals such as licensed electrologists may legally perform laser hair removal treatments without direct supervision, however they must have a off-site medical director (MD).
